TERMS & CONDITIONS: (Important please read before purchasing.)


DEFINITIONS: “Playford” means Empire Pavers Pty. Ltd. trading as Playford Pavers ABN 68 139 280 381.

“Goods” means any product manufactured, imported or traded by Playford Pavers as shown on the invoice, purchase order or other document. “Buyer” means the person or entity ordering Goods as shown on the invoice, purchase order or other document making an order for Goods.


PRICING & PAYMENT: Payment via cash, credit card, EFT, cleared personal cheque or bank cheque with order, unless credit arrangements are made prior to delivery. Prices are subject to alteration without notice, and where a deposit only has been received at the time of order, deliveries will be made at prices current at the time of dispatch. All quotations are therefore liable to alteration unless otherwise negotiated. Prices will be held at that quoted only at the time of receiving payment in full. Products remain the property of Playford Pavers Pty. Ltd. (hereafter 'Playford') until full payment has been received.


ESTIMATES: Estimates and quotations are given as guidance only as to the number of pavers and/or products required. Playford will not accept responsibility for inaccuracy or claims for variations. The customer will be charged for all products delivered.


30 DAY ACCOUNTS: (Trade Only)

Accounts are for Trade customers only and are subject to approval and limit. At Playford’s discretion a Directors Guarantee maybe required to facilitate an account. Playford reserves the right to appoint COD or seven (7) day account terms for a period it deems appropriate before credit approval is granted.


Accounts are thirty (30) days only. (30 days from end of month the product was purchased.)


If payment cannot be made within due date then notification to Playford must be made at least one (1) week prior to due date. Extensions will be reviewed on an individual basis. If accounts remain unpaid beyond the due date Playford reserves the right to recover monies and seek other reasonable compensation through its legal resources.


CANCELLATION: Cancellation of confirmed orders by the Buyer must be made in writing, prior to the commencement of delivery. In the event that the Buyer cancels delivery of Goods, the Buyer shall be liable for any costs incurred by Playford up to the time of cancellation, including but not limited to any re stocking fees incurred by Playford. Playford may cancel delivery of Goods at any time before delivery by giving written notice to the Buyer. Playford shall not be liable for any loss or damage whatever arising from such cancellation.


PALLETS:

The Buyer is subject to a pallet deposit as specified at the time of purchase. Deposit is refundable upon return of pallets in merchantable condition to; Playford Pavers, 2 Christopher Court, Salisbury North SA 5108. Pallet pick up service available. Please call (08) 8258 8945.


Pallets remain the property of Playford Pavers Pty. Ltd. at all times.


DELIVERY: The Buyer shall be responsible for making any necessary arrangements to take delivery of the Goods and supplying the correct delivery address and directions. Delivery of the Goods to any third party nominated by the Buyer (including carriers) is deemed to be delivery to the Buyer. Should Playford fail to deliver all or part of the Goods, Playford shall not be liable for any loss or damage incurred by the Buyer, or any of the Buyers agents, customers, related companies, or contractors. We will do our utmost to meet all delivery requirements, but can make no guarantee for things beyond our control. Goods delivered to unattended sites are the Buyers responsibility and no claims of shortages or damages, however caused, will be honoured under any circumstances. Trucks entering the Buyers property or worksite at the Buyers request do so entirely at the Buyers risk and Playford will not accept any liability for damage.


NOTIFICATION OF DEFECTS:

The Buyer shall inspect the Goods upon delivery and notify Playford within forty-eight (48) hours of any alleged defects, or failure to fulfil the quotation. Playford will be given access to any Goods within a reasonable time after delivery in order to inspect any alleged defects in the Goods.


Should the Buyer fail to give such notification, the Goods/Services will be deemed to be in compliance with those ordered, and free from any defects whatsoever.


While all due care will be taken, Goods supplied are a hand made product using natural raw materials, and thus may have colour and thickness variations from samples, surface imperfections, and chipping. Chipped or damaged pavers up to 5% in number, and thickness variation of up to +/- 3mm are considered to be within acceptable industry standards and will not be considered defective.


It is recommended that all Goods be delivered or collected at the same time to reduce the risk of variation. Installers should blend product across pallets and layers for this same reason.


Efflorescence is not considered a defect. It is a potential problem across the entire concrete paving industry. As a consequence, as it is beyond our control, no warranties are given.


WARRANTIES:

Where Playford has agreed in writing that the Buyer is entitled to claim under warranty, Playford’s liability is limited to replacing Goods only.


Any costs associated with the return of Goods for the purpose of a warranty claim shall be the responsibility of the Buyer. Returns will not be accepted as a result of incorrect or over-ordering.


CONDITIONS OF WARRANTY:

Playford’s warranty will not be applicable in a situation where;

The Buyer or their contractor has incorrectly laid the Goods.

The Goods have been used in a manner other than their original intended use.

The defect or fault has occurred from reasonable wear and tear in use.

The defect or fault has occurred as a result of circumstances beyond the control of either the Buyer or Playford.


The Playford accepts no responsibility for loss or damage to the Buyer, financial or otherwise, arising from a delay in the time taken for Playford to replace any Goods covered by the warranty.


LIMITATION OF LIABILITY:

The liability of Playford to the Buyer for any reason related to the performance of the Goods under this agreement shall be limited to the amount paid or payable by the Buyer to Playford for such Goods.


TRADING TERMS AND CONDITIONS:

A) Product returns are subject to our credit policy, including a 25% restocking fee plus freight. Claims for damaged or faulty products must be made within 7 days. Specialty orders are only credited at our discretion.

C) STRICTLY payment before delivery. Interest may be charged on overdue amounts.

D) We take no responsibility for over or under calculations of product quantities on your behalf. We will not accept return for credit of products left over and we cannot be held liable if you run out of products.
